Kudos to the forum members who have suggested that refund is in order. I agree.

While both parties could be criticized for taking on such a complex transaction/delivery without proper preparation, in the end Blacksheep sold his boat for his asking price (or more?).

This transaction had disaster written all over it, but right now, Dirk is bearing the brunt of the "disaster"!

One man's opinion!

Mike

Jon needs to understand his own culpability in the matter.

According to Jon's own ebay terms of the sale for the item in question :

Quote:
Payment Terms :

Remember a bid is a contract and will be considered as such. The Winning bidder
(buyer) agrees to make contact within 24 hours of auction via telephone.
The buyer shall deliver to the seller a $300 nonrefundable deposit via paypal,
cashiers check or money order within 3 business days from the date of auction close.
The balance shall be paid to the seller by cash, cashier's check or money order within 5
business days of the auction close. Upon payment of the entire balance, the vessel
registration will be handed over and bill of sale shall be drafted and signed.

Jon is legally obligated to keep only $300.00, he needs to refund the remainder.

This one isn't bad karma, its horrible karma. Live up to the ebay terms and return the deposit minus the $300 and incurred expenses. I personally wouldn't want this one to follow me, and would like to have all ended with a clean conscience.

I am really pleased by the responses here. Not sure if it will change the outcome but it might give one pause. Keeping $1000 ducats of a fellow forum member's money after the boat was sold in the same time frame seems pretty low no matter how you slice it.

The post about the actual "$300" deposit required in the ebay ad even further amplifies the point.

just two words for the preparation of the deal and its process: ....money was paid (though I had rather wanted to pay the rest after having some receipt from shipping ageny in Baltimore), I had a quote for the overseas transport from a shipping agency, I had Jon Blacksheeps offer to trailer the boat to Baltimore ( of course for expenses plus some proper benefit). And I had asked Jon Blacksheep to figure out a suitable trailer so I could order it. This one didnt work...so it was quite close and could have worked, I was really in good hope :-)
I guess Jon Blacksheep had some better offer from somebody else, so he refused to finish the deal.

Ok, never mind, it didnt work, and now I hope to get some appopriate amount of money back. Interesting to hear, there was no cost for the slip etc...

Regards
Dirk

Your not getting the entire story and I am done with the drama. I wash my hands of it. I will take the bullet and look like the bad guy, not the first and not the last I am sure. It is not about karma it is about respect.

Sure you're really upset. The bullet? More like the ducats. Why didnt you just go ahead and ask $7000? It's a pretty sad story considering you were given help right and left. Even the people that gave you help dont get your position.

You sure earned a lot of respect here.

Lord, I think ole Lake Loon was mostly tongue in cheek, here. Man, this forum has been up for a year and the only posts that I can think of that delve into the truly sorry are under your moniker... It's like a 15yr old under the guise of an adult. See the thread "Kupe" for further evidence.

Dirk, it looks like you met up with the wrong guy. I'm just sorry that this exchange took place on this forum. It's surely not the norm here as 99% have great experiences with fellow F235 owners.

Jon, Where is it that you live, I have some brothers up your way would you like to speak with one of them? I don't take to kindly of any threat nor do my club members I ride with. Do you want to get together? I have no problem with that. You just tell me where you want me or one of my brothers and trust me someone will be there. You should know who your threats are going too.
Neil had me with his post and you just closed the deal..... Jon, do you want this to go any further just say the word, I can have a rep in your area within hours. Just say the word! Post you adress and I will have someone there ASAP. It might not be me but we are all one in the same. LFFL

was it your brothers I said I had a beef with? uh no! it was you!

Niel is right & so am I, dude you list a $300 non refundable deposit the guy gives you $1000, ok so the guy expects to much help from you, fine.
Then you get frustrated & call the deal off, hey thats ok too.
But then you keep $700 bucks. WTF!

so what I gather is your word means nothing.
and as far as your MC threats....stick em! & grow up.
This ain't no Rolling Stones concert.

I did not make the threat, you did do you want to follow through? If so post where you live and I have no problem with dealing with your threats.

It was a $1000 deposit because of it be overseas, we agreed to that and because this guy has no follow through he loses the deposit. End of story.

Jon, if you insult my club or my brothers it will be bigger then just you and I. Watch yourself.

I think we're all flogging a dead horse at this stage. What's the point of prolonging the agony by more posts/counterposts in this thread? Don't we have anything positive to discuss? JM2C
(Kelly - can a thread remain viewable but unable to accept new posts?)
I move to close this thread forever - anyone want to second the motion?

Second I had just sent a PM to Kelly requesting the same thing.
Please end this, it is not doing anyone any good, except perhaps entertaining those that are encouraging it.
